Written agreement requirement for residential buyers <— Link
Beginning January 1, 2026, you will need to enter into a written agreement with prospective buyers of residential property. The written agreement must be signed prior to showing a property, or if there is no showing, before presenting a purchase offer on behalf of the prospective buyer. The written agreement can be a full representation agreement or a showing only agreement without representation if that is the only service being provided.

FAQ on Listing Agreements

TXR 1101 - Residential Real Estate Listing Agreement, Exclusive Right to Sell

(In MOST cases, you will enter a % or flat fee in paragraph 5.A.1.a AND 5.A.2.a,
UNLESS the seller is offering NO BAC, then enter a % or flat fee in 5.B.1.a)

Question: I represent a seller whose existing appraisal has one number for the square footage while the appraisal district has another number. How should I report this to potential buyers?

Answer: If you list the square footage of a property, you should always quote the information source and let prospective buyers know if you have any reason to know that the information is false or inaccurate. Use the Notice of Information from Other Sources (TXR 2502) to report this information. In this scenario, you could report both square footage numbers and cite the source for each number.

Cheat Sheet for Compensation:

Option 1:
If the listing agent uses Paragraph 5a from the listing agreement, you need to put the BAC at the bottom of page 10 & have a TXR 2402 completed prior to your offer being presented.

Option 2:
If the listing agent uses Paragraph 5b from the listing agreement, put your requested BAC in paragraph 12.A.1.b of the contract. Nothing goes at the bottom of page 10 and no additional TXR forms needed (other than your Buyer Rep {TXR 1501 or 1507}).

If the listing agent can't tell you, doesn't answer the phone or doesn't sign your TXR 2402, then use option 2 above.
