Important July 1 Forms Update

Beginning July 1, 2026, Texas REALTORS® forms will no longer include broker-to-broker compensation fields in the listing agreement. Buyer broker compensation will be handled through the purchase contract, specifically Paragraph 12, when the buyer requests the seller to pay that compensation. Since Paragraph 5.A. is going away, we recommend agents begin using Paragraph 5.B. now, which only identifies the listing broker’s compensation and does not offer buyer broker compensation.

Mandatory:
Written agreement requirement for residential buyers <— Link
you will need to enter into a written agreement with prospective buyers of residential property. The written agreement must be signed prior to showing a property, or if there is no showing, before presenting a purchase offer on behalf of the prospective buyer. The written agreement can be a full representation agreement or a showing only agreement without representation if that is the only service being provided.

TXR 1101- Residential Real Estate Listing Agreement, Exclusive Right to Sell


Question: I represent a seller whose existing appraisal has one number for the square footage while the appraisal district has another number. How should I report this to potential buyers?

Answer: If you list the square footage of a property, you should always quote the information source and let prospective buyers know if you have any reason to know that the information is false or inaccurate. Use the Notice of Information from Other Sources (TXR 2502) to report this information. In this scenario, you could report both square footage numbers and cite the source for each number.

All Buyer Agency Compensation will be detailed in Paragraph 12 of the contract.
Broker to Broker compensation will no longer exist.
